JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 This application, for grant of anticipatory bail, arises out of Buxar (Industrial) P.S. Case No. 261/18, disclosing offences under Sections 25(1b)a, 26 and 35 of the Arms Act. Allegation as per F.I.R. is that police on information that some miscreants are fighting with each other raided the place and apprehended two persons and others succeeded in fleeing away and on search of apprehended accused one country made pistol and a mobile was recovered and they disclosed the name of petitioner and others. Apart from that he is an accused in one more case of similar nature. Submission of learned counsel for the petitioner is that save and except disclosure made by the apprehended person, there is nothing against the petitioner so as to connect him with the present case.

Having heard both sides, considering the facts and circumstances as well as the fact that petitioner is an accused in one more case of similar nature, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, if possible on same day, without being prejudiced by this order.
