This application is for grant of regular bail in connection with Bhagwanpur Hat P.S.Case No.93 of 2017 dated 29.4.2017, for the offences punishable under Sections 420, 413 and 414 of the Indian Penal Code.

Allegation, as per FIR against the petitioner is that the police raided the orchard and a large number of stolen motorcycle were recovered and on one of the motorcycle, the petitioner was sitting.

Submission of the learned counsel for the petitioner is that the motorcycle on which the petitioner was sitting is of his uncle and he has produced paper also but the chassis number of the said motorcycle has been changed to implicate the petitioner to

Patna High Court Cr.Misc. No.40015 of 2017 (2) dt.23-08-2017 2/2 the fact that earlier he had alteration with the I.O. of the case and now he is in custody for about four months. The petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, the learned court below is directed to verify the criminal antecedent of the petitioner and if the petitioner has no criminal antecedent, he shall be released on bail in connection with Bhagwanpur Hat P.S.Casae No.93 of 2017 to the satisfaction of A.C.J.M.-II, Siwan.

With the aforesaid observation, this application is disposed of.
