The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 376, 379, 506 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have smeared vermilion on the forehead of the informant and on the pretext of marriage, established physical relation several times with her. Lastly, when informant went to the house of petitioner, she was refused and ousted from the house by petitioner and his family members.

Petitioner denies the allegation levelled against him. It is submitted that petitioner has been falsely implicated in this case by the informant only with a view to harass him. As per F.I.R. itself, no case under Section 376 of the I.P.C. is made out against this petitioner. Petitioner has got clean antecedent.

No.17369 of 2022(2) dt.27-09-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific and direct allegation against this petitioner of establishing physical relation on several times on the pretext of marriage and lastly when the informant went to the house of petitioner, she was ousted by this petitioner and his family members.

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
