The petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Sections 25(1b)a, 26(i) and 35 of the Arms Act. The prosecution case, in short, is that a country made muskat and 8 live cartridges are recovered from the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.09.2021. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. It is alleged that a country made muskat and 8 live cartridges are recovered. There is no compliance of Section 100
Patna High Court CR. MISC. No.15387 of 2023(2) dt.01-05-2023 2/2 of Cr.P.C. There is no chance of trial being concluded in near future.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with S.Tr. No. 142/2022 arising out of Jhajha P.S. case No. 278/21.
