There is a public policy behind barring certain individuals from consideration for selection on the post of Anganbari Sevika. The definition has been expanded or explained from time to time. Such a prohibition has an object and purpose behind implementation of such policy. If such a bar has come in the way of the petitioner being selected or appointed by the Aam Sabha and that position has been certified by the Divisional Commissioner with a direction for fresh selection, this Court will not come in the way of such direction. If there is a change in situation, now, the
Patna High Court CWJC No.1332 of 2014 dt.12-02-2015 2/2 petitioner can offer herself as a candidate, if she does not violate the relationship clause, which has been notified till date.
No interference, otherwise, with the order is required. The dismissal of the writ application will not come in the way of the petitioner, offering herself as a candidate.
Writ application stands dismissed with observation as above.
