In this case, the petitioners are seeking anticipatory bail in connection with Bajpatti P.S. Case No. 328 of 2018, registered for the offence under Sections 341, 323, 307, 427, 325, 504 and 506/34 of the Indian Penal Code. The dispute arose on account of damaging the paddy and Masuri crop of the informant, later on, the son of the informant was intercepted by the petitioners and assaulted mercilessly. Specific allegation has been made against the petitioner no.1 to have inflicted knife blow upon the son of the informant. There is no direct allegation against the petitioner
Patna High Court CR. MISC. No.16270 of 2019(2) dt.25-03-2019 2/2 nos. 2 to 4 save and except general and omnibus. Considering the aforesaid facts, let the abovenamed petitioner nos. 2 to 4, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Bajpatti P.S. Case No.328 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
So far the bail of petitioner no. 1 is concerned, the same is rejected.
