Petitioner seeks bail in a case registered for the offence punishable under Section 304 (B) of the Indian Penal Code.
The sister of the informant died in unnatural circumstances in her matrimonial house. Petitioner is younger brother of the husband of the deceased. The husband of the deceased is not an accused in this case.
The F.I.R. reveals that there was family dispute between the two brothers (petitioner and husband of the informant) and for that reason murder of the victim might have been committed. Though there is allegation of demand of dowry, however, contention is that the informant has given in
Patna High Court CR. MISC. No.16992 of 2019(3) dt.15-05-2019 2/2 writing before the court below that the victim died of illness. Considering the aforesaid material and completion of investigation of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Vaishali Police Station Case No.288 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
