Learned counsel for the petitioner draws attention of this Court to the statement of the victim girl recorded under Section 164 of Criminal Procedure Code wherein she has clearly stated that she had eloped on her own. Court has assessed her age to be of 19 years. It is further pointed out that once before also, the victim girl had run away from the house for which her father had lodged another case. She further states that she has now married with a third person.

Be that as it may, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.30091 of 2014 (2) dt.14-01-2015 within four weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in Kotwa Police Station Case No 295 of 2013 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
