2. The petitioner has preferred this application for grant of regular bail in connection with Simri Bakhtiyarpur P.S. Case No. 350 of 2025 dated 22.11.2025 registered for the offences punishable under Sections 8(c) and 21(b) of the N.D.P.S. Act.

3. As per the allegation, total 46.70 grams of smack like substance has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It has been further submitted that no contraband article has

Moreover, no procedure, as prescribed under Section 50 of N.D.P.S Act, has been followed and the amount recovered from the possession is intermediary quantity. It is further submitted that petitioner is in custody since 22.11.2025, although he is accused in one other case but not of similar nature.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case as well as period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saharsa in connection with Simri Bakhtiyarpur P.S. Case No. 350 of 2025.

7. The application stands allowed.
