2. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 22.05.2023 in Cr. Misc. No. 32295 of 2023.

3. The petitioner seeks bail in connection with Nawada (Nagar) P.S. Case No. 376 of 2021 registered for the offence punishable under Sections 33, 34 and 36 of the Bihar Prohibition and Excise Act, 2016.

4. The petitioner is accused of selling illicit liquor due to which one person is alleged to have died. The petitioner has been made accused in a number of case and he is in jail since 05.04.2021 but in the present, he has been remanded on 05.01.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-1, Nawada in connection with Nawada (Nagar) P.S. Case No. 376 of 2021.

7. As a condition of this order, the petitioner, on being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on the dates fixed for hearing.

8. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Muffasil Police Station, Nawada on every Sunday of the month.
