The petitioner is languishing in custody since 3.12.2018 in a case registered for the offences punishable under Section 395 of the I.P.C.

The prosecution case is that the informant Md. Nasim alias Pappu was carrying cash amount of Rupees One Lac Thirty Thousand at the dictate of his employer when on the way, it was robbed by five motorcycle borne miscreants, leading to registration of FIR against unknown. The petitioner was arrested in other case in which he made confession about committing the offence of robbery of the informant's money. It is submitted by learned counsel for the petitioner that the investigation has already been concluded but neither there is no recovery from possession of the petitioner nor the petitioner

Patna High Court CR. MISC. No. 16216 of 2019(2) dt.15-03-2019 2/2 has been put on Test Identification Parade, though the petitioner is accused in two other cases.

Learned APP submitted that the petitioner has confessed his guilt.

Considering the petitioner's confession made before the police, coupled with the fact that neither there is any recovery from the petitioner nor the petitioner has been put on Test Identification Parade, the period in custody and the fact that investigation has already been concluded, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No.220 of 2018.
