The petitioner is apprehending his arrest for the offences instituted under Sections 302/34 of the Indian Penal Code. The prosecution story, in brief, is that sister of the informant Niku Devi was married with one accused Sunil Kumar Singh before 12 years ago and she has one girl and two minor sons. It is further alleged that the petitioner along with other coaccused persons killed her sister after beating indiscriminately and hanged after wrapping the rope in her neck and there was sign of rope in her neck. It is mentioned in the written petition that there was illicit relation with Bhabhi and Devar.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.24441 of 2015 (3) dt.03-09-2015 P2/2 petitioner is the Gotni of the deceased and she has got no criminal antecedent. She has been made accused due to mistake of fact. The husband of the deceased is in custody.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bishunpur P.S. Case No. 14/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
