JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-12-2022 In pursuance to the earlier order of this Court dated 28.09.2022, a counter affidavit has been filed on behalf of respondent no. 2, wherein, it has been stated that the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 has already been passed by the Circle Officer, Bhargama,

Patna High Court CWJC No.4700 of 2022(4) dt.14-12-2022 2/2 Araria, in connection with Encroachment case no. 01 of 202122, which is annexed as Annexure-B to the said counter affidavit.

In such view of the matter, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the aforesaid final order dated 05.03.2022, passed by the Circle Officer, Bhargama, Araria, in connection with Encroachment case no. 01 of 2021-22, by filing appropriate Appeal. Liberty so sought, is granted.

The writ petition stands disposed off, however, with the aforesaid liberty.
