JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 447 of the Indian Penal Code. The accusation against the petitioner and one Raj Kumar Yadav is to have assaulted the informant when Raj Kumar Yadav snatched gold chain from the informant. The petitioner is also alleged to have assaulted Phanu Yadav and Dewal Yadav by axe and snatched silver chain from Sariya Devi. It is submitted by learned counsel for the petitioner that the petitioner is the agnate of the informant. Though, five persons from the informant's side have received injury but all injuries have been found to be of marginal size or bruise which cannot be caused by sharp cutting weapon like axe, though, the opinion with

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Katoria P.S. Case No. 134 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
