The petitioner seeks regular bail in connection with Gaunaha PS case no. 143 of 2018 registered for the offence punishable under Section 379 of Indian Penal Code. The allegation is regarding the dacoity having been committed in the office of L & T Finance at Gaunaha Branch and a sum of about Rs. 18 lacs approximately was taken away by the miscreants.

The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner herein nor the petitioner has been apprehended from the spot, however his name has transpired during the confessional statement made by co-accused Abhinandan Mishra. It is further

No.15289 of 2019(2) dt.12-03-2019 2/2 submitted that the entire money which was stolen by the miscreants, has already been recovered though not from the possession of the petitioner herein, hence the petitioner is fit to be enlarged on regular bail. Lastly, it is submitted that the petitioner is having clean antecedent and is languishing in custody since 13.12.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bettiah in connection with Gaunaha PS case no. 143 of 2018.
