Petitioners seek anticipatory bail in Bounsi P.S. Case No. 177 of 2014 registered under sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code. The allegation is that they along with others conjointly assaulted the informant and his brother. It is stated that the application be permitted to be withdrawn enabling the petitioner to appear before the Court below in the light of a decision of the Court in Mahendra Prasad Singh Vs. State of Bihar 2004 (3) PLJR 491 and seek bail as in similar circumstance, an order was passed to the same effect in Cr. Misc. No. 47714 of 2015. After hearing both sides, the application stands disposed of

Patna High Court Cr.Misc. No.17343 of 2016 (2) dt.09-05-2016 2/2 as withdrawn with liberty to the petitioner to appear before the Court below and pray for regular bail.
