The petitioner, already in custody, seeks bail in connection with Balia P.S.Case No. 54 of 2017 registered under Sections 147, 148, 149, 323, 326, 341 and 307 of the Indian penal Code and Section 27 of the Arms Act.

Allegation in brief is that due to land dispute, all accused persons assaulted the informant. It is further alleged that accused Mithilesh Kumar shot at the stomach of his son Deepak @ Dillo by Katta causing injury.

Submission is that there is land dispute between the informant and the petitioner's family and the specific allegation is against Sikandar Yadav and Mithilesh Yadav and due to land dispute, all male family members of the petitioner have been

No.43457 of 2017 (2) dt.20-09-2017 2/2 made accused moreover this petitioner has got no criminal antecedent and has been in custody since 23.03.2017 and similarly situated one of the co-accused having no specific overt act has been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 20.09.2017 passed in Cr. Misc. No. 42408 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Shyamdeo Yadav @ Shayamdeo Yadav @ Shayamadeo Yadav @ Shamdeo Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Balia P.S.
