03-07-2018 Heard Sri Ajay Kumar Jain, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is lady, apprehending her arrest in Hawai Adda P.S. Case No. 58 of 2018 (Special Case No. 2452 of 2018) registered for offence under Sections 30(a), 37(c) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of her arrest or surrender. Learned counsel for the petitioner, by way of referring to F.I.R. and seizure list, submits that nothing was recovered from the premises of the petitioner, rather in the case, from outside the house of the petitioner, beside a drain, a container containing 5 liters of country-made Mahua liquor was recovered and petitioner, being resident of nearby place, has been made accused. Considering the fact that petitioner is a lady, having clean antecedent as well as the fact that nothing was recovered from the premises of the petitioner, in the event of her arrest or surrender within a period of six weeks from today, let the petitioner namely Pramila Devi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Hawai Adda P.S. Case No. 58 of 2018 (Special Case No. 2452 of 2018), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
