The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365, 366(A)/34 of the Indian Penal Code.

Though allegation is of kidnapping of the daughter of the informant for the purpose of marriage, however, submission is that the victim is a major, which would be evident from her school leaving certificate at Annexure 2. Moreover, she has sworn affidavit that she has voluntarily married with petitioner, Pawan Singh @ Pawan Kumar. The affidavit and marriage certificate bears photographs of the two. However, afterwards the victim has gone in the clutches of the informant and in pressure she has made statement under Section

Patna High Court CR. MISC. No.16089 of 2019(2) dt.14-03-2019 2/2 164 of the Code of Criminal Procedure against the petitioner. Prima facie matter appears to be of love affairs and marriage.

Hence, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Manihari Police Station Case No.27 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
