JUSTICE SHIVAJI PANDEY ORAL ORDER 08-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in connection with Araria P.S. Case No. 409 of 2019 registered for offences under sections 341, 323, 379, 384, 504, 506 of the Indian Penal Code.
As per prosecution case, the nephew of the Informant was returning to his house after appearing in the examination and when he reached near the Mahadeo Chowk, a tempo stopped near him. At the same time, a person on cycle also reached there and all the three persons started demanding money from him. The name of the petitioner has come during investigation.
The petitioner has criminal antecedent of the similar nature of offence.
Looking to the entire facts and circumstances of the case as also the petitioner having criminal antecedent, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected with a liberty to renew his prayer for bail after one year of his judicial custody.
