The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant happens to be nephew of the petitioner. The informant alleged that he went to demand money from his uncle Dinesh Dubey @ Dineshwar Dubey, the petitioner for meeting the expenses of study of his son and the petitioner is said to have assaulted the informant and also opened firing, but the firing did not hit the informant.
It is submitted that a simple dispute occurred between the uncle and the nephew. The father of the informant died much earlier.The petitioner brought up the informant, but he used to take
Patna High Court Cr.Misc. No.29151 of 2015 (2) dt.27-07-2015 2/2 wine and that is why this false case has been lodged. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua in Bhabhua P.S. Case No. 146 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
