JUSTICE RAVI RANJAN ORAL ORDER 25-05-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under sections 420, 409 and 471 of the Indian Penal Code.
As per the allegation, paddy was purchased by the PACS on fake land receipts given by the concerned.
It is contended on behalf of the petitioner that only for the two alleged fake receipts, the petitioner has been implicated in the matter as he happens to be the Chairman of the PACS. It is further contended that even the land receipts were not fake and in support of his submission the copies of the land receipts with the certificate of the concerned Revenue Officer have been appended as Annexures 2 and 3.
Patna High Court Cr.Misc. No.17466 of 2016 (3) dt.25-05-2016 Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Ramesh Prasad, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Motihari Muffasil Police Station Case No. 180 of 2015 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
