JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-07-2018 The petitioner seeks bail in connection with Jamo Bazar P.S. Case No. 92 of 2017 dated 21.06.2017 instituted for the offences under Sections 304(B), 201, 120(B)/34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that though the petitioner has been named in the F.I.R but the allegations are general and omnibus in nature. He has further submitted that the marriage of the deceased took place about ten years ago and hence, prima facie, the offence under Section 304(B) of the Indian Penal Code would not get attracted. The witnesses, during the course of investigation have stated that the deceased had stomach trouble and while

Patna High Court Cr.Misc. No.35315 of 2018 (2) dt.06-07-2018 2/2 she was being taken to the local hospital for treatment, she died. Apart from that, the other witnesses have only made a general statement that the deceased was done to death out of a larger conspiracy to eliminate her for non-fulfillment of dowry demand.

The petitioner is in custody since 24.03.2018. Mr. Krishna Kant Singh, learned advocate for the petitioner has submitted that the husband of the deceased has been arrested today.

Regard being had to the aforestated facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XIII, Siwan in connection with Jamo Bazar P.S.
