JUSTICE ALOK KUMAR SINHA ORAL ORDER 14-05-2026 Heard learned counsel for the petitioner, assisted by Mr. Shashwat Srivastava and Dr. Anand Kumar, learned counsel, appearing for the respondent-University.

2. With the consent of the parties, this writ application is being disposed of at this stage itself.

3. The petitioner, in the present writ application,

2/4 has prayed for the grant of the following relief:- "For issuance of an appropriate writ, order or direction in the nature of Mandamus, commanding the Respondents, particularly Respondent Nos. 1 and 2, to permit the petitioner to fill up the B.Ed. Second Year examination form and to allow her to appear in the said examination, inasmuch as the petitioner had submitted a detailed representation dated 03.05.2025 before the Controller of Examination. Aryabhatta Knowledge University, Bihar, which was duly forwarded and recommended by the Principal of the affiliated college, yet the same has not been considered or decided till date, thereby causing grave prejudice to the petitioner."

After advancing some argument, learned counsel for the petitioner submits that for seeking the aforesaid relief, the petitioner has already filed a representation dated 03.05.2025 (Annexure-P/4) before the Controller of Examination, Aryabhatta Knowledge University, Bihar, Patna (respondent no.2), which as per the petitioner, continues to be pending. He, therefore, submits that the petitioner would be satisfied if an appropriate direction could be issued to the respondent no.2 to dispose of the pending representation of the

3/4 petitioner, within a fixed time-frame, after giving an opportunity of hearing to the petitioner.

5. For the aforesaid submission made by the learned counsel for the petitioner, learned counsel, appearing for the respondent-University, does not have any objection.

Considering the limited nature of prayer made by learned counsel for the petitioner, the present writ application is disposed of, directing the respondent no.2, i.e., the Controller of Examination, Aryabhatta Knowledge University, Bihar, Patna to dispose of the pending representation of the petitioner dated 03.05.2025 (Annexure-P/4) within eight weeks from the date of receipt/production of a copy of this order, after giving an opportunity of hearing to the petitioner.

7. Needless to emphasize that the final order, which shall be passed by the respondent no.2, should be a reasoned and speaking order, and in case the petitioner is found entitled to the relief, which the petitioner is claiming through the pending representation, then the same should be extended to the petitioner within a further period of four weeks from the date of passing of the final order by respondent no.2.

8. With the aforesaid observation/direction, this writ application stands disposed of.
