JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in Chapra Town P.S.Case No. 21 of 2015 instituted under Sections 406, 409, 420, 467, 468 and 120(B) of the Indian Penal Code, pending in the Court of learned C.J.M., Chapra (Saran).

This is a case of embezzlement of Rs. 87 lacs from the Syndicate Bank, Chapra and this petitioner is an Assistant Manager of the Bank.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case due to mistake of fact. The allegation made against the petitioner has been denied.

On behalf of the State it has been submitted that there is

Patna High Court Cr.Misc. No.25214 of 2015 (4) dt.23-09-2015 2/2 direct allegation of misappropriation of Rs. 87 lacs against the petitioner and others. The bail applications of other co-accused have been rejected vide Cr.Misc. No.13675 of 2015 and Cr. Misc. No. 15634 of 2015.

Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner and the same is rejected. Any how, if the petitioner surrenders in the court below within a period of six weeks and prays for regular bail, same shall be considered by the court below on its own merit without being prejudiced by this order of rejection.
