JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 The petitioner apprehends his arrest in connection with Dhaka P.S.Case No. 13 of 2019 registered under Sections 25(1b)a/26 and 35 of the Arms Act and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 37 litres and odd of liquor as well as one country made pistol along with live cartridge from the brother of the petitioner and he has named the petitioner in this case.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and though he is accused in one more case but that has been lodged with respect to present case only.

Having heard both sides and in the facts and

Patna High Court CR. MISC. No.15313 of 2019(2) dt.12-03-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Motihari in connection with Dhaka P.S. Case No. 13 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
