The petitioner seeks bail in a case registered under Sections 366(A)/363 of the Indian Penal Code. Allegation is that accused Azaz Ansari hunted the minor daughter of the informant. The informant has apprehension that accused will engage her daughter in illegal acts.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.2.2020 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner has falsely been implicated in
Patna High Court CR. MISC. No.15660 of 2020(2) dt.06-03-2020 2/2 the present case. His name has come in course of investigation. The victim girl is alleged to have eloped with Azaz Ansari. It is alleged that the said boy is said to have used sim card of this petitioner. Except for this, there is no other substantive evidence to suggest his implication in this case. The petitioner has got no concern with the alleged occurrence.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 5th, Saran at Chapra in connection with Kopa P.S. case No.202 of 2019.
