JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Ganga Bridge P.S. Case No. 43 of 2018 for the offences under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case no case under Section 414 of the Indian Penal Code is made out against the petitioner. He further submits that no incriminating material has been seized from the conscious possession of the petitioner. The petitioner is languishing in jail since 24.03.2018.

Considering the fact that the petitioner has no criminal antecedent and has remained in custody for nearly two

Case No. 43 of 2018.
