The petitioner seeks bail in a case registered under Sections 25(1-b)a, 26 and 35 of the Arms Act and Section-30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case, in short, is that 27.6 liters wine and one country-made pistol along with cartridge are recovered. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 12-01-2019. Charge sheet in this case has already been submitted. 27.6 litres wine and one country-made pistol along with cartridge are recovered. There is no compliance of Section 100 Cr.P.C.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari in connection with Dhaka P.S. Case No. 13 of 2019.
