2. The petitioner seeks bail in connection with Andhramath P.S. Case No. 93 of 2025 registered for the offence under Sections 103, 80, 3(5) of the BNS.
3. As per the prosecution case, the petitioner is accused of killing his wife.
4. The petitioner is in custody since 10.06.2025.
5. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case as the deceased has committed suicide. He next submits that the petitioner is in custody for more than one year and the trial is delayed as in the trial only charges have been framed.
6. Learned counsel for the State has opposed the application of the petitioner.
7. Considering the period of custody of the
Patna High Court CR. MISC. No.19378 of 2026(7) dt.30-06-2026 2/2 petitioner and the delay in trial, this application is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Andhramath P.S. Case No. 93 of 2025.
9. As a condition of this order, the Court below before accepting the bail bonds of the petitioner, is directed to verify the statement of the learned counsel for the petitioner that in the trial only charges have been framed. If the same is found to be true then the bail bonds of the petitioner shall be accepted and if the same is found to be false then the bail bonds of the petitioner shall not be accepted.
10. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
