The sole petitioner, who is in custody since 04-06-2017 in Ex. Case No. 1547 of 2017, arising out of Ara Town P.S. Case No. 303 of 2017 registered for offence under Sections 30(a) and 56 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
At the very outset, it was submitted by learned counsel for the petitioner that driver of the vehicle, from whose possession huge quantity of Indian make foreign liquor was recovered, has already been granted bail, vide Cr. Misc. No. 38701 of 2017. Learned counsel for the petitioner, by way of referring to statement made in paragraph - 3 of the petition, submits that
Patna High Court Cr.Misc. No.39725 of 2017 (2) dt.19-08-2017 2/2 petitioner is having clean antecedent.
Considering the nature of accusation, clean antecedent as well as the fact that one of the co-accused has been granted bail, there is no reason to further detain the petitioner. Let the petitioner namely Guddu Singh @ Shambhu Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Bhojpur at Ara in connection with Ex. Case 1547 of 2017, arising out of Ara Town P.S. Case No. 303 of 2017.
