The petitioners seek bail in connection with Nokha (Dharampura) P.S. Case no. 219 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 379, 307, 504, 506 of the Indian Penal Code and under Section 27 of the Arms Act. As per prosecution case, when the informant was planting seedling in his filed, the accused Ramashish Singh came and assaulted on his head by means of bhala and also gave order to Sanjay Singh who fired on the head of Bishnu Kumar Singh, on account of which he sustained forehead injury. They also assaulted his brother and wife and took away cash of Rs. 5,000/- from his pocket.

Patna High Court Cr.Misc. No.39579 of 2017 (2) dt.19-08-2017 2/2 It is submitted by the learned counsel for the petitioners that there is case and counter case between the parties. The petitioners have falsely been implicated in this case due to aforesaid case and land dispute. The injury sustained by the informant is simple in nature and caused by hard and blunt substance. The injury sustained by Bishnu Singh is also simple in nature. The petitioner has been languishing in custody since 16.07.2017.

Considering the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Sasaram, District-Rohtas in connection with Nokha (Dharampura) P.S. Case no. 219 of 2017.
