JUSTICE ARUN KUMAR ORAL ORDER 28-06-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 16.4.2018, seeks bail in Kathaiya PS Case No. 68 of 2018 registered under Sections 363 and 366A of the IPC.

The allegation in brief is that the informant's sister was enticed away by Rahul Kumar and this petitioner. Learned Counsel for the petitioner submits that the girl was recovered, she has made statement under Section 164 Cr.P.C. accepting the fact of having married with Rahul Kumar and she has not stated anything against the petitioner and even as per the school certificate she is 17 years of age.

Learned Counsel appearing on behalf of the informant opposed the prayer for bail.

Having considered the said facts and circumstances, the petitioner, namely, Sunny Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM 2nd Muzaffarpur (West) in connection with Kathaiya PS Case No. 68 of 2018.
