JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-02-2023 Heard learned counsel for the parties concerned. The petitioner, Ranjeet Prasad Singh, had two brother, namely, Rambir Prasad Singh and Shyamvir Prasad Singh. All the three brothers filed a petition before the Circle Officer, Brahampur giving the details of land with prayer that in the revenue record the names of the three brothers are jointly recorded after the death of their father, accordingly, they wanted that a separate revenue record be created in their favour. The Circle Officer, Brahampur vide Annexure-2 created separate mutation for the land in question in the names of all the three brothers.

During the pendency of this writ application, Ranjeet

The prayer of the petitioner in the present writ application is that pursuant to the Annexure-2 i.e. order of mutation with regard to the subject land mentioned in Annexure-1 and 2, a necessary correction is to be made in the entry of the computer with regard to land situated in Khata No. 24, Plot No. 6 area 71 decimal, Plot No. 524 area 50 decimal, Khata No. 26, Plot No. 933 area 95 decimal, Plot No. 943 area 36 decimal, Khata No. 89 Plot No. 692 area 14 decimal mauza Akodhi, Thana 288, Buxar, which was standing in the name of the father of the petitioners.

Learned counsel for the State submits that the fact of the matter is that the land is disputed and for which Title Suit No. 87 of 2014 is pending before the Civil Court in which the original writ petitioner, Ranjeet Prasad Singh is the plaintiff and Laxman Singh, Sri Bhagwan Singh, Pawan Kumar Singh and Ranvir Singh are defendants.

Accordingly, his submission is that necessary correction in the computer shall be made after decision of the Civil Court in the aforesaid Title Suit No. 87 of 2014. In view of the submission made by the learned counsel for the State, this writ application is disposed with
