The petitioner seeks bail in connection with Warsaliganj P.S. Case no. 80 of 2018 registered under Sections Sections 30(a)/ 41 of Bihar Prohibition and Excise Act-2016. 87 lts. of Hariyana made liquor is said to have been recovered from a locked room of the community hall in Kochgaon allegedly kept there by the petitioner and two other accused persons as per revelation of the locals. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The identity and genuineness of the source of information has not been mentioned in the self statement of the informant. He has no criminal antecedent. He has been languishing in custody since 21.05.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Nawada in connection with Warsaliganj P.S.
