The petitioner apprehends his arrest in connection with Banka P.S. Case No. 411 of 2008 registered for the offences punishable under Sections 467, 468, 471, 409, 420, 120(B) of the Indian Penal Code.

It is submitted on behalf of the petitioner that neither the petitioner named in the First Information Report of the aforementioned case nor he was charge sheeted. However, during the course of trial, the petitioner's name surfaced and

Patna High Court Cr.Misc. No.31017 of 2014 (3) dt.20-01-2015 2/2 he was issued summons under Section 319 Cr.P.C. for facing trial. It is further submitted that another similarly situated accused person, who was also summoned in connection with the aforesaid case under Section 319 Cr.P.C. has been extended the privilege of anticipatory bail by a Bench of this Hon'ble Court by order dated 09.12.2014 passed in Cr. Misc. No. 29164 of 2014 .

Considering the aforesaid submissions and the petitioner has already been summoned under Section 319 Cr.P.C. for facing trial even though after due investigation, the police had not submitted charge sheet against the petitioner, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Banka in connection with Banka P.S. Case No. 411 of 2008 corresponding to G.R. No. 1389 of 2008, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) Jagdish/- U T
