JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Ara Nawada Police Station Case No. 313 of 2015, disclosing offences under Sections 419/420/467/ 468/471/379/504/34 of the Indian Penal Code.

It has been pointed out by learned Counsel appearing on behalf of the informant that with identical allegation against the petitioner in relation to different transactions, another First Information Report, being Ara Nawada Police Station Case No. 256 of 2015 has been registered.

Learned Counsel for the petitioner has fairly conceded that allegation in the said First Information Report, giving rise to Ara Nawada Police Station Case No. 256 of 2015, is identical to the allegation made in the present First Information Report.

I have perused the order of the Court, dated 15.07.2016, passed in Criminal Misc. No. 17224 of 2016. Considering the said order, I am not inclined to grant the petitioner privilege of anticipatory bail. This application for anticipatory bail, is hereby, rejected.

The petitioner, Lalit Narayan Chaudhary, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
