JUSTICE SANJAY KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned A.P.P. appearing on behalf of the State.

The petitioner seeks regular bail in connection with Kuchaikote P.S. Case No. 172 of 2017 registered for the offences punishable under Section 370 of the Indian Penal Code and Sections 3/4/5/6/7 of PITA Act.

The informant of this case is S.H.O. of Gopalganj Police Station. He conducted raid at Vinayak Hotel (Rajbhog Hotel) at Sasamusa Bazar and on search, he found several male and female staying in different room in suspicious condition. The petitioner happens to be one of them. Accordingly, on the written report, the present case has been registered under Section 370 of the Indian Penal Code and Sections 3/4/5/6/7 of the Prevention of Immoral Trafficking Act.

No.43852 of 2017 (2) dt.20-09-2017 2/2 It has been submitted that three F.I.R. named namely, Manjeet Kumar Paswan and Puja Devi @ Sita Devi having similar allegation have been allowed bail by the learned V Additional Sessions Judge, Gopalganj in B.P. No. 945 of 2017. Another co-accused namely Dhananjay Singh, who happens to be the owner of the hotel has also been allowed bail on 19.09.2017 in Criminal Miscellaneous No. 45137 of 2017. The petitioner is in custody since 29.06.2017, having no criminal antecedent. The case of this petitioner stands on similar footing. The learned APP for the State opposed the submission.

Considering the facts and circumstances of the case and also the fact that the case of this petitioner on similar footing, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Gopalganj in connection with Kuchaikote P.S. Case No. 172 of 2017.
