Petitioner is in custody in connection with Hasanpur P.S. Case No. 27 of 2018 for the offence under section 272, 273 of the Indian Penal Code and Sections 41, 30(A), 38 (1) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is in custody since 16.2.2018 and he has no criminal antecedent. He further submits that other co-accused have been granted bail.

From the stamp report, it appears that Rajesh Kumar Ranjan @ Rajesh Yadav was granted bail anticipatory bail in Cr. Misc. No. 20404 of 2018 vide order dated 06.04.2018, Surendra Yadav @ Sulo Yadav was granted anticipatory bail in

Patna High Court Cr.Misc. No.37297 of 2018(2) dt.28-06-2018 2/2 Cr. Misc. No. 17800 of 2018 vide order dated 29.03.2018 and Jaikant Kumar Yadav @ Jaikant Kumar was granted regular bail in Cr. Misc. No. 20663 of 2018 vide order dated 16.04.2018 whereas other two co-accused were granted anticipatory bail namely, Ranveer Yadav and Subash Kumar @ Subash Yadav. Considering the aforesaid, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3 cum Special Judge Excise, Samastipur, in connection with Hasanpur P.S. Case No. 27 of 2018.
