JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner, who is in custody since 24.01.2020, seeks bail in connection with Pakaribarawan P.S. Case No. 18/20, dated 23.01.2020, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

There is a recovery of 50 litres of liquor from the possession of the petitioner.

Learned counsel for the petitioner submits that the motorcycle which is said to have been driven by the petitioner is not his and the arrest of the petitioner is only on mistaken identity. The petitioner has clean antecedents.

Considering the aforestated facts, the petitioner is directed to be released on bail on his

Patna High Court CR. MISC. No.14265 of 2020(2) dt.04-03-2020 2/2 furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Nawada in connection with Pakaribarawan P.S. Case No. 18/2020.

The application stands allowed.
