Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 504, 506 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

It is alleged by the informant being the cook of the school that petitioner being Headmaster abused the informant by calling caste name.

It is submitted by learned counsel for the petitioner that for the occurrence of 31.07.2014 the First Information Report was registered on 03.09.2014. Moreover the informant has retracted from the initial version and filed a petition to that effect before learned Court below. The same has been brought on record as Annexure-2.

Considering the delayed lodging of the F.I.R

Patna High Court Cr.Misc. No.23752 of 2015 (2) dt.09-07-2015 2/2 and the retracted version of the informant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj SC/ST P.S. Case No. 41 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
