ANJANA MISHRA ORAL ORDER 01-07-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Raushanganj P.S. Case No.16 of 2016 for allegedly having committed the offences under Sections 143, 147, 149, 152, 282, 332, 353, 307 of the Indian Penal Code and Section 3(i)(x) of the SC/ST Act.

Learned counsel for the petitioner submits that in the occurrence, as described by the informant, the petitioner has no active role to play and at best he can be treated as a member of the mob, who has caused obstruction in the official discharge of the duty of the informant. So far as the provisions of Section 3(i)(x) of the S.C./S.T. are concerned, it is

Considering the nature of allegations made against the petitioner and that no specific role has been assigned to him, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati, District-Gaya, in connection with Raushanganj P.S. Case No.16 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
