The petitioners have renewed their prayer of prearrest bail which was twice rejected by this Court vide order dated 10.1.2011 and 5.1.2012 passed in Cr. Misc. Nos. 40946 of 2009 and 698 of 2012 respectively in connection with Mahua P.S. Case No. 296 of 2009 on the ground that now after investigation chargesheet has not been submitted under Section 7 of the Essential Commodities Act rather only under Section 414 Indian Penal Code.

In the facts and circumstances stated above, this Court is not persuaded to grant the privilege of pre-arrest bail to

Patna High Court Cr.Misc. No.30462 of 2014 (2) dt.21-01-2015 the petitioners, accordingly, their such prayer stands rejected. However, the petitioners are directed to surrender before the court below and seek regular bail and their prayer for bail shall be considered on its own merit on the same day without being prejudiced by the present order.
