The petitioner, who is in custody, seeks bail in connection with Mahnar P.S. Case No. 274 of 2017 registered for the offence punishable under Sections 302, 120B/34 of the Indian Penal Code and 27 of Arms Act.
Informant is the brother of deceased, who has stated in his fardbeyan that on 01.12.2017 at about 6.00 PM he was sitting alongwith his elder brother Sharwan Kumar where the motorcycle boarded criminals entered the shop and another criminal came walking and shot dead the brother and thereafter all of them flee away from the motorcycle. He could identify them if they are brought before him. Petitioner is wife
Patna High Court Cr.Misc. No.35459 of 2018(2) dt.20-06-2018 2/2 of Sahdev Sah, allegation against whom is that he had committed the murder of his brother by hired criminals and petitioner was also a party in said conspiracy. Petitioner is in judicial custody since 04.12.2017 and has no criminal antecedent.
Earlier this Court has rejected the bail application of the petitioner with an observation that after completing six months of custody in jail he can renew his prayer for regular bail.
In view of the above, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-VI, Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 274 of 2017. (S. Kumar, J) veena/- U T
