JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-11-2017 The petitioner seeks regular bail in connection with Lauriya P.S. Case No. 102 of 2017, registered for offences punishable under Sections 302, 201 and 34 of Indian Penal Code. Allegation against the petitioner is of causing death of his wife.

It has been submitted on behalf of the petitioner that the case is based only on suspicion and there is no material against the petitioner and as a matter of fact, the deceased was ill and petitioner has taken her for her treatment and, thereafter, she became traceless and he has also informed the informant about the same but this case was lodged against the petitioner and later on dead body of the deceased was recovered by the U.P. police. He has been in custody for last 25.04.2017.

Patna High Court Cr.Misc. No.44191 of 2017 (4) dt.23-11-2017 Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and serious nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the commitment of the case and after commitment expedite the trial and try to conclude the same within a period of nine months. (Vinod Kumar Sinha, J) sunil/- U T
