2. The petitioner has preferred this application for grant of regular bail in connection with Atri P.S. Case No. 359 of 2023 dated 25.07.2023 registered for the offence punishable u/ss 302, 506 and read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, on 23.07.2023 at about 6:00 P.M. the informant was sitting along with Kajal and Chandani at the house of Anjali Devi in the meantime the petitioner holding electric live wire wrapped with Bamboo and the co-accused entered the house of Anjali Devi and the

Patna High Court CR. MISC. No.17756 of 2024(4) dt.31-07-2024 2/3 petitioner along with co-accused persons got Anjali Devi electoructed with naked live wire due to that she died. On cry of the informant, Ajeet Yadav came and informed the Police. They also threatened the informant and others to kill.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is the father-in-law of the deceased and he has no concern with the said occurrence rather it is a case of accidental death. There is general and omnibus allegation against the petitioner. It is further submitted that due to property dispute the name of the petitioner has implicated in the present case. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 21.10.2023.

Learned A.P.P. for the State and learned counsel for the informant has vehemently opposed the bail petition of the petitioner by submitting that the petitioner has committed murder of his daughter-in-law with intent to grab all her property. As per the post-mortem report, death may be due to electoruction.

6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the

Patna High Court CR. MISC. No.17756 of 2024(4) dt.31-07-2024 3/3 petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Atri P.S. Case No. 359 of 2023 pending in the court of learned Chief Judicial Magistrate, Gaya.
