JUSTICE JYOTI SARAN ORAL ORDER 05-05-2016 Heard Mr. S.B.K. Manglam, counsel for the petitioner, counsel for the State and State Election Commission. Mr. Manglam appearing for the petitioner seeks to raise a grievance on behalf of the voters of Territorial Constituency Nos. 7, 8 and 9 who have been shifted to a different Constituency Nos. 10 and 7. In my opinion, the writ petition is a proxy litigation, for the persons who have been shifted are not before this Court raising any grievance. Insofar as the petitioner is concerned the representation against the change in Ward present at Annexure-3 is dated 23.2.2016 i.e. almost one month after the objections to a draft voter list was

Patna High Court CWJC No.7941 of 2016 (2) dt.05-05-2016 invited by the Commission. The petitioner having woken up from a slumber cannot be granted indulgence more particularly where the election is now round the corner.

The writ petition is disposed of.
