====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 20-06-2024 Heard learned counsel for the petitioner and learned counsel for the respondents.

2. The present writ petition has been filed for compassionate appointment of the petitioner's younger son as her husband was died working as Greaser at IWAI, Patna during the service period.

3. Learned counsel for the petitioner submits that

Patna High Court CWJC No.5533 of 2020(8) dt.20-06-2024 2/2 counter affidavit has been filed in which the specific stand has been taken by the respondent authorities in which it has been mentioned that compassionate appointment can be made upto a maximum of 5% of vacancies following under direct recruitment quota in any Group-C post and at present 5% quota on compassionate appointment has already been filled up and name of the petitioner has been placed in the waiting list.

4. In the light of the stand taken by the respondent authorities, this Court hereby directs the respondent authorities that name of the petitioner be continue in the waiting list and as and when the appropriate time shall come, his case shall be considered for compassionate appointment in accordance with law.

5. Hence, with the aforesaid direction, this writ petition is hereby disposed off.
