JUSTICE SATYAVRAT VERMA ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a), 41 and 52 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.12.2021, charge-sheet has been submitted and has antecedent of two cases.

Allegation is of recovery of 1433 litre of liquor from a Bolero vehicle.

Learned counsel for the petitioner submits that petitioner was not arrested from the spot and name of the

No.16339 of 2022(2) dt.08-04-2022 2/2 petitioner transpired in the confessional statement of co-accused Vinod Rai and Subodh Kumar who have been granted bail by order dated 16.09.2021 in Cr. Misc. No. 36586 of 2021 and order dated 17.09.2021 in Cr. Misc. No. 37202 of 2021. Learned counsel further submits that co-accused, in whose confessional statement name of this petitioner transpired, have been granted bail, as such, the petitioner deserves to be enlarged bail. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.12.2021, charge-sheet has been submitted, was not arrested from the spot and co-accused have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Vaishali (Belsar O.P.) P.S. Case No. 73 of 2021. (Satyavrat Verma, J) Kundan/- U T
