Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-09-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 498A and other ancillary sections of the Indian Penal Code and sections 67A/66E of the IT Act.

Prosecution case is that the petitioner made semi nude photograph of informant's daughter and sent the same to her husband with fake Whats app ID. It is further alleged that the petitioner and other accused persons got disappeared the victim for pushing her in flesh trade.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim in her statement recorded under section 164 Cr.

Patna High Court CR. MISC. No.16667 of 2022(5) dt.22-09-2022 2/2 P. C. has not named the petitioner or made any allegation against him. Her age in the said statement has been disclosed as 23 years. Petitioner has got no criminal antecedent. Learned counsel appearing for the State as well as the informant oppose the prayer for bail.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Chhauradano Police Station Case No. 256 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
